2. What data we collect
2.1 When visiting the website
When you access our website, the following data is automatically recorded by the server (so-called server log files):
- IP address of the requesting device (anonymised)
- Date and time of access
- Name and URL of the file accessed
- Referrer URL (the page previously visited)
- Browser and operating system used
Legal basis: Art. 6 (1) (f) GDPR (legitimate interest in the technical provision of the website). Storage period: max. 7 days.
2.2 Registration and account use
When you create an account with theartwallet, we collect:
- Email address
- Self-chosen password (stored encrypted)
- Optional profile information (e.g. name, profile picture)
- Artworks and collection data you record
- Technical usage data (e.g. login times, device)
Legal basis: Art. 6 (1) (b) GDPR (performance of a contract).
2.3 Payment processing (paid plans)
For paid subscriptions, payment data is processed via external payment service providers. We do not store full payment data (e.g. credit card numbers). Legal basis: Art. 6 (1) (b) GDPR.
2.4 Newsletter
When you sign up for the newsletter, we collect your email address and the date of registration. Consent may be withdrawn at any time. Legal basis: Art. 6 (1) (a) GDPR (consent).
3. Disclaimer — valuations and market data
IMPORTANT NOTE: The valuations, Kunstfaktor (KF) figures, artist scores and value developments displayed on theartwallet expressly do not constitute investment advice, a purchase recommendation or a binding valuation.
All valuations are based on statistical models and historical sales data of the German art market. They are provided for informational and guidance purposes only. We accept no liability for:
- Purchasing decisions made on the basis of the displayed valuations
- Differences between displayed value and actually achievable market price
- Loss of value of artworks in the collection
- Errors, omissions or delays in the market data displayed
- Losses arising from reliance on the accuracy of the valuations
The art market is subject to substantial fluctuations. Past performance is not a reliable indicator of future developments. theartwallet is an information and management tool, not a financial service provider.
4. Disclaimer — technical availability
We strive for a high availability of the platform, but accept no guarantee for:
- Interruptions or outages of the service
- Data loss due to technical errors
- Damage from unauthorised third-party access to our systems
- Contents of external websites we link to
Liability for slight negligence is excluded to the extent permitted by law. This does not apply to damages resulting from injury to life, body or health, nor to intentional or grossly negligent breaches of duty.
